can someone tell me how to disable the NOT using our name servers for new accounts.

I hate that new feature that changes the name servers to whatever is being used by whois.

Cpanel should remove it! lol

Or if someone can tell me how to disable it forever that would be fine.

Login to WHM and go to "Tweak Settings" and uncheck the following line:

"When adding a new domain, if the domain is already registered, ignore the configured nameservers, and set the NS line to the authoritative (registered) ones."
