I had a tech looking into this. Yesterday he asked for my root password. He said that the s attribute should be working and wanted to look into why. Was not thrilled but gave it to him anyway.
Of course, he logged in around 3 in the afternoon yesterday and I've not heard back from him.

We opened a ticket too, the reply we got was less than impressive.
Having explained it wasn't working in the ticket our reply was basically "everything is correct are you having a problem?"
I had explained that we had to CHMOD 0755 to get it to work and replied to my ticket and not had a reply in days!

It doesn't run because it's suid. Remove it or set the permissions to 755 (both as explained by others earlier) and it should work for you. My question about the free CGI scripts that Cpanel offers, is why they are compiled Perl, instead of the source code, where no one can do anything to fix some fo the problems. That's really annoying and it's even more annoying to have to wait on fixes--especially for things like Formmail (it's a very simple script.) I'd recommend replacing all the CGI scripts with your own, superior scripts and be rid of these dumb problems.

The 0755 chmod fixes it -- too bad they couldn't solve it with my trouble ticket. My only hope is that this thread will help others.

So what happens on the next time you update cPanel after a 755 chmod? Does it revert back to bad permissions? I dont want to chattr +i cgiecho and cgiemail just for a fix ???

Just talked to nick about this, apparently cgiemail installs in /cgi-bin/. Dont use the one in cgi-sys, i assume cpanel just copys it outta that dir. I notified nick that the X theme uses the wrong path as well.

THIS problem still exists and re-breaks with every update, even in STABLE. Someone please fix it!

I have a fix for xcontroller in the link in my signature.
I am okay with the way this works, but I am concerned, as if there is a vulnerability discovered with cgiemail, nick will put the new one in cgi-sys, but since it is getting copied to the user's cgi-bin, then all the previous copies won't get updated unless a client visits the scripts area of his control panel again.
I'd like to hear what will be done if there is a cgiemail (or any other cgi located in cgi-sys) update.

We must be absolutely blind as we do not see anywhere that the CGIemail scripts installs to the customers /cgi-bin. We've checked over a dozen servers and it's always available only via /cgi-sys.
The only way we have been able to fix this issue is to use the /cgi-sys version and remove the sticky bit and then mark it as immutable (which of course prevents cPanel from updating it with bug/security fixes, so it's not preferred).
We'd love to know where and how you guys see it getting installed into the user's /cgi-bin.
