apache not properly setting default virtualhost?

    I recently got a new server that I'm moving sites onto ... now I noticed a weird problem when testing with 2 dummy accounts that don't have important sites on them - apache seems to overwrite the defaults for the virtualhosts with my current configuration, and I have no idea why (using apache 2) ... IE, if I copy say 3 sites from the old server, it uses the first site when I go to the server's main IP (instead of the one in htdocs like it should) ... I fixed this by adding the default virtualhost directives to the previrtualhost include, but I consider that a hack that shouldnt be done if it's done right ... so is this a bug of some sort? or is there a particular configuration that causes this?
