i am just a little confused because most people seem to refer to whm as cpanel. it seems to me that whm is the server management piece and cpanel is the account management piece but are they the same company?

Yes, as you say "whm is the server management piece and cpanel is the account management piece".
When you install cPanel you get both WHM and cPanel, there is no one without the other.

    Overview | cPanel, Inc.

cPanel is the name of the overall product.

The WebHost Manager is the server administrator interface.

cPanel is the end-user Web-site-owner interface.

They are part of the same product and you cannot have cPanel without the WHM. (You can have the WHM without cPanel, in cPanel DNS-only, but that is a specialty item.) The overall product is called cPanel. Within the context of the overall product, though, the server administration interface is called the WHM, and the site owner interface is called cPanel.
