Here's the official solution, I've done this countless times before:

# pico /etc/nameserverips

Change the following:
1.1.1.1=ns1.notyourdomain.com

to

1.1.1.1=ns1.yourdomain.com

If you don't replace it with anything, the alien domain will just show up again. It doesn't matter if there's a nameserver record somewhere pointing to your IP, you can assign multiple nameservers to an IP.

The owner of a domain can add, change and delete name server entries for his domain at any given time according to Icann rules. Your registrar has to pass on these modifications to the root servers during the updates twice a week.
If they do not then they do not comply with Icann rules.
If the domain expires though the name server entries will not get automatically deleted because they are registered separately in the root servers.
So contact your registrar (an Icann Registrar and not a domain reseller!) and tell them what you need to do and they can take care of it.
One thing though to make sure is that the NS record you want to change or delete is not used in any active domain record otherwise the modification can be rejected!
So the way to do it is to first find out what domains still use the NS record, change these domains to use another NS and then delete or modify the NS record.

What is the reasoning behind this, anyway? Setting up DNS in WHM and creating glue records at the registrar are completely separate things.

Ok, im having the same problem as above, you guys keep saying contact the registrar !! but how do I know who the registrar is or how to contact them.

From day one my server has had an ns assigned to my main IP. When I try and remove it I get the good old

Sorry, the nameserver ip 65.xxx.xxx.xxx cannot be removing since it is still registered with an ICANN register

the ns is NS1.DWEBFORUMS.COM

I used whois to look up the Domain DWEBFORUMS.COM
and it did not sow the webpage using the ns above but
Creation Date: 10-May-2004
Expiration Date: 10-May-2005

Domain servers in listed order:
ns1.tek-labs.com
ns2.tek-labs.com

maybe im going about this the wrong way I would be thankful for any help

thanks in advance

btw, tek-labs.com is the domain name reseller through whom the domain was registered, and by whom the site is probably hosted.

with directi, if you have access to your domain account there, then you can just login and view your domains details, and then click on Child Nameservers, and it should show you the nameservers and ips that are registered with the registry... you can then delete them or edit them.

ya that would work if I owned the domain, but I dont someone else does and they have it registered with ICANN using my ip, i cannot remove this... well just read the post above ...

thanks for everyone who helped, I have sent a email to tek-labs.com
and am waiting for a reply.

To whom it may concern:

NS1.DWEBFORUMS.COM is using 65.xxx.xxx.xxx illegally and with consent
nor payment. I would like this removed from the ICANN.

Thank you
