Restarting httpd

I have lighttpd installed on my server. My host has provided me with 4 IPs, of which lighttpd utilizes 1. Occasionally apache fails and when that happens it doesn't restart properly. The error logs show a make_sock issue when trying to bind the socket for the local ip (127.0.0.1) to port 80, saying it's already in use, but this isn't correct. And when I use apachectl to restart apache as opposed to using the Restart in WHM, it restarts fine.

What could be causing this issue?

try netstat -anp |grep 80
to see what's running on port 80
