Web protect creating blank .htaccess file

We have have several non-fp customers having a problem with cpanel\'s web protect feature creating a blank .htaccess file any ideas?

How deep of a directory in relation to the webroot of the account is/are these files being created in? (straight within public_html/DIRECTORY... or deeper yet?

And, what are the permission bits on /public_html and within..........
